The term "newatech" is used to refer to newatech Inc. The term "client" refers to all who holds account of newatech, where the term "account" refers to the access, content, and services that newatech provides to its clients. By signing up for any account of newatech, you agree that you obey all our policies, terms and conditions.

Newatech provides an Internet domain name registration, hosting service, and web designing service. Newatech reserves the right to suspend or cancel a customer's access to any or all services provided by Newatech when Newatech decides that the account has been inappropriately used or otherwise.

• Domain Name Registration:
  We make no representation that the domain name you wish to register is capable of being registered by or for you or that it will be registered in your name. You should therefore not assume registration of your requested domain name(s) until you have been notified that it has or they have been registered. Any action taken by you before such notification is at your risk.

  The relevant naming authority subject to the terms and conditions of use applies the registration and use of your domain name; you shall ensure that you are aware of those terms and conditions and that you comply with them. You shall have no right to bring any claim against us in respect of refusal to register a domain name. Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the naming authority to register your desired name. More information can be found here at icann.

  We shall have no liability in respect of the use by you of any domain name; any dispute between you and any other person must be resolved between the parties concerned in such dispute. If any such dispute arises, we shall be entitled, at our discretion and without giving any reason, to withhold, suspend or cancel the domain name. We shall also be entitled to make representations to the relevant naming authority but will not be obliged to take part in any such dispute. We shall not release any domain to another provider unless full payment for that domain has been received by us.

• Domain & Reseller Hosting:
  Newatech reserves the right to refuse service and /or access to its servers to anyone.
  Newatech does not allow any of the following content to be stored on its servers:
  
  

  Illegal Material - any material which constitutes, or encourages the commission of, a criminal offence or which infringes any patent, trade mark, design right, copyright or any other intellectual property right or similar rights of any person which may subsist under the laws of any jurisdiction.

  Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Newatech. Also includes any sites, which provide "links to" information about such material or advertising for such material.

  Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material. Newatech prohibits using the server as file storage for commercial distribution requiring unacceptable usage of bandwidth. This includes MP3, software or any other type of files. You may store files if you are not draining too many resources. Streaming media is not allowed on any of our servers.

  Sending unsolicited emails using our server is strictly prohibited. This is considered illegal and will cause your account [Mail/Web] to be suspended or permanently disabled. Running IRC or chat scripts on the server is also prohibited.

• Services:
  newatech has sole right to discontinue or change the price and plans at any time without prior notification .

• Account:
  The clients will be responsible for holding their account and maintaining the confidentiality of passwords used by themselves or any authorized user of their account.

• Email:
  newatech clients should maintain a current email address in the newateh database. Clients should notify in case their email address changes.

• Limited Bandwidth/Traffic Usage:
  All Linux hosting plans have a set allotment of Bandwidth available for use. Any bandwidth usage that is over the limit of the monthly allotment will be charged according to the terms that is set forth in the order form. Unused bandwidth may not be carried over to the following month.

• Hign Resource User Policy:
  Resources are defined as bandwidth and/or processor utilization. Newatech may implement the following policy to its sole discretion: When a website found to be monopolizing the resources available, the account holder will be contacted in order to discuss the situation. If no arrangement can be reached, Newatech reserves the right to terminate the account.

• Chat Rooms:
  We do not allow clients to install their own chat rooms, without approving it with the Newatech Support Team. Most chat rooms tend to be large system hogs and we cannot allow it as an account option.

• CGI based message boards:
  We don't allow to use CGI based message board scripts (like UBB, UB2K, 360forum, etc. )as such scripts on busy sites bring high load to CPU and memory and at high load can take server down. Please, consider using php based bulleting boards like Vbulleting, phpBB, XMB, Burning board, etc. instead. These boards php and MySQL based and cause much lighter load to the server.

• IRC:
  We currently do not allow IRC or IRC bots to be operated on our servers unless you have prior permission from a Newatech system administrator.

• Background Running Programs:
  We may allow programs to run continually in the background. These are considered on a one-to-one basis and an extra charge will be incurred based on system resources used and operational maintenance needed.

• Cancellation:
  Newatech reserves the right to cancel service at any time.

• Indemnificaion:
  Registered user agrees that it shall defend, indemnify, save and hold Newatech harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against Newatech, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Newatech against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Newatech's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Newatech's server.

• Disclaimer:
  Newatech will not be responsible for any damages your business may suffer. Newatech makes no warranties of any kind, expressed or implied for services we provide. Newatech disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Newatech and its employees. Newatech reserves the right to revise its policies at any time.
